公务员公开遴选办法（2013年1月24日中共中央 组织部、人力资源社会保障 部制定2021年8月25日中 共中央组织部修订2021年 9月17日发布）第一章总则第一条为优化领导机 关公务员队伍结构，建立健 全来自基层的公务员培养选 拔机制，规范公务员公开遴 选工作，根据中华人民共 和国公务员法和公务员 转任规定等有关法律法 规，制定本办法。公务员公开遴选办法(2021修订)MeasuresforthePublicSelectionofCivilServants(2021Revision)制定机关：中共中央组织部公布日期：2021.09.17施行日期：2021.09.17效力位阶：党内法规制度法规类别：公务员IssuingAuthority：OrganizationDepartmentof(heCentralCommitteeoftheCommunistPartyofChina(OrganizationDepartment,CCCPC)DateIssued：09-17-2021EffectiveDate:09-17-20211.evelofAuthority：SystemofPartyRegulationsAreaofLaw:CivilServantsMeasuresforthePublicSelectionofCivilServants(DevelopedbytheOrganizationDepartmentoftheCPCCentralCommitteeandtheMinistryofHumanResourcesandSocialSecurityonJanuary24,2013,andrevisedonAugust25,2021andissuedonSeptember17,2021bytheOrganizationDepartmentoftheCPCCentralCommittee)ChapterIGeneralProvisionsArticle1TheseMeasuresaredevelopedinaccordancewiththeCivilServantLawofthePeople'sRepublicofChina,theProvisionsontheTransferofPostsofCivilServants,andotherapplicablelawsandregulationsforthepurposesofoptimizingthestructureofcivilservantsinleadingauthorities,establishingandimprovingatrainingandselectionmechanismforcivilservantsfromtheprimarylevel,andregulatingthepublicselectionofcivilservants.Article2ForthepurposeoftheseMeasures,upublicselectionmeansthemerit-basedpublicselectionandappointmentofcivilservantsbyauthoritiesatorabovethecity(prefecture)levelfortheirinternalbodiesfromauthoritiesatlowerlevels.Publicselection,asoneofthewaysforcivilservantstobetransferredtoanotherpostatthesamelevel,shallhighlighttheneedsoftheworkandbesubjecttoanappropriatescale.Ifthepublicselectionofcivilservantsisrelatedtothepromotiontoordemotionfrompositionsofleadershipandranksortheinterchangeofpositionsofleadershipandranks,therelevantprovisionsshallapply.Article3ThepublicselectionofcivilservantsshallfollowtheprincipleofmanagementofofficialsbytheCommunistPartyofChina(CPC)5highlightpoliticalstandards,adheretobothmoralintegrityandcapabilitywithprioritygiventomoralintegrity,adheretomeritsregardlessoftheirorigins,adheretoprofessionaldedication,commensurationofpersonswiththeirpostsandofficialduties,andimpartiality,underscoreactualperformanceandpublicrecognition,andadheretothehandlingofaffairsaccordingtolawsandregulations.Article4Thepublicselectionofcivilservantsshallbeorganizedtotheextentofthespecifiedsizeofstaffingestablishmentsandthenumberofposts,andbeconditionaluponcorrespondingvacancies.第二条本办法所称公开遴选，是指市（地）级以上机关从下级机关公开择优选拔任用内设机构公务员。公开遴选是公务员转任方式之一，应当突出工作需要，保持适度规模。公开遴选中涉及领导职务和职级升降、领导职务和职级互相转任的，按照有关规定办理。第三条公开遴选坚持党管干部原则，突出政治标准，坚持德才兼备、以德为先、任人唯贤，坚持事业为上、人岗相适、人事相宜，坚持公道正派、注重实绩、群众公认，坚持依法依规办事。第四条公开遴选应当在规定的编制限额和职数内进行，并有相应的职位空缺。Article5Thepublicselectionofcivilservantsshallgenerallybeorganizedunderthefollowingprocedures:第五条公开遴选一般按照下列程序进行：（一）发布公告;(1) Issuanceofanannouncement.（二）报名与资格审查;(2) Registrationfortheexaminationandqualificationreview.（三）考试;(3) Examinations.（四）考察;（五）决定与任职。(4) Assessment.(5) Decisionandappointment.省级以上公务员主管部门可 以根据需要对上述程序进行 调整。Civilservicedepartmentsatorabovetheprovinciallevelmayadjusttheaboveproceduresasappropriate.第六条市（地）级以 上公务员主管部门按照管理 权限和职责分工负责公开遴 选工作的综合管理。公开遴 选机关按照公务员主管部门 的要求，负责公开遴选有关 工作。Article6Civilservicedepartmentsatorabovethecity(prefecture)levelshallberesponsibleforthecomprehensivemanagementofthepublicselectionofcivilservantsaccordingtotheiradministrativepowersandthedivisionoftheirduties.Publicselectionagenciesshallberesponsiblefortheworkrelatedtothepublicselectionofcivilservantsaccordingtotherequirementsofcivilservicedepartments.公开遴选有关专业性、技术 性、事务性工作，可以授权 或者委托考试机构以及其他 专业机构承担。Examinationinstitutionsandotherprofessionalinstitutionsmaybeauthorizedorengagedtoundertaketheprofessional,technical,orclericalworkinconnectionwiththepublicselection.第七条省级机关和市 （地）级机关公开遴选，原 则上面向本辖区内下级机关 （含相应层级中央机关直属Article7Aprovincialauthorityoranauthorityatthecityorprefecturelevelshall,inprinciple,organizepublicselectionamongcivilservantsofauthoritiesatlowerlevels(includingtheinstitutionsdirectlyunderthecentralauthoritiesatthecorrespondinglevel)withintheirrespectivejurisdictions.Whereaprovincialcivilservicedepartmentneedstoorganizepublicselectionoutsidetheprovince(autonomousregionormunicipalitydirectlyundertheCentralGovernment)becauseofservingandguaranteeingmajornationalstrategicdecisionsandarrangements,itshallcommunicatewiththecentralcivilservice机构）公务员进行。因服务 保障国家重大战略决策部署 等需要面向本省（自治区、 直辖市）以外进行的，省级 公务员主管部门应当事先与 中央公务员主管部门沟通。departmentinadvance.省级公务员主管部门应当对 本辖区内公开遴选工作进行 统筹，合理确定时间和频 次，一般应当集中开展。Chapter Il Application Plans and Announcement第二章申报计划与发布公 告Aprovincialcivilservicedepartmentshallmakeoverallplansfor,reasonablydeterminethetimingandfrequencyof,andgenerallyorganizeinacentralizedmanner,thepublicselectionofcivilservantswithinitsjurisdiction.第八条公开遴选机关 在进行公务员队伍结构和职 位分析的基础上，根据工作 需要，提出公开遴选职位及 其资格条件，拟定公开遴选 计划，报公务员主管部门审 批。第九条组织公开遴选 前，应当依据有关法律法规 和政策
