食品安全标准管理办法MeasuresfortheAdministrationofFoodSafetyStandards制定机关：国家卫生健康委员会发文字号：中华人民共和国国家卫生健康委员会令第10号公布日期:2023.11.03施行日期：2023.12.01效力位阶：部门规章法规类别：食品卫生IssuingAuthority：NationalHealthCommissionDocumentNumber：OrderNo.IOoftheNationalHealthAdministrationofthePeople'sRepublicofChinaDateIssued：11-03-2023EffectiveDale:12-01-20231.evelofAuthority：DepartmentalRulesAreaofLaw:FoodHygieneOrderoftheNationalHealthCommissionofthe中华人民共和国国家卫生健康委People'sRepublicofChina员会令(No. 10)（第10号）食品安全标准管理办法已经 2023年9月28日第1次委务会 议审议通过，现予公布，自2023 年12月1日起施行。主任马晓伟2023年11月3日TheMeasuresfortheAdministrationofFoodSafetyStandards,asdeliberatedandadoptedatthe1stexecutivemeetingonSeptember28,2023,areherebyissued,andshallcomeintoforceonDecember1,2023.Director:MaXiaoweiNovember3,2023食品安全标准管理办法第一章总则第一条为规范食品安全标 准管理工作，落实“最严谨的标 准”要求，根据中华人民共和 国食品安全法及其实施条例， 制定本办法。第二条 本办法适用于食品 安全国家标准的制定、修改、公 布等相关管理工作及食品安全地 方标准备案工作。食品安全标准是强制执行的标 准，包括食品安全国家标准和食 品安全地方标准。第三条国家卫生健康委员 会（以下简称国家卫生健康委） 依法会同国务院有关部门负责食 品安全国家标准的制定、公布工 作。各省、自治区、直辖市人民政府 卫生健康主管部门（以下简称省 级卫生健康主管部门）负责食品 安全地方标准制定、公布和备案 工作。MeasuresfortheAdministrationofFoodSafetyStandardsChapterIGeneralProvisionsArticle1TheseMeasuresaredevelopedinaccordancewiththeFoodSafetyLawofthePeople'sRepublicofChinaandtheregulationontheimplementationthereofforthepurposesofregulatingtheadministrationoffoodsafetystandardsandimplementingtherequirementsofthemostrigorousstandards.Article2TheseMeasuresshallapplytothedevelopment,amendment,andissuanceofnationalfoodsafetystandardsandotherrelevantadministrationworkaswellastherecordationoflocalfoodsafetystandards.Foodsafetystandardsarecompulsorystandards,includingnationalfoodsafetystandardsandlocalfoodsafetystandards.Article3TheNationalHealthAdministration(NHC)shall,inconjunctionwiththerelevantdepartmentsoftheStateCouncil,belegallyresponsibleforthedevelopmentandissuanceofnationalfoodsafetystandards.Thehealthadministrativedepartmentsofpeople,sgovernmentsofallprovinces,autonomousregions,andmunicipalitiesdirectlyundertheCentralGovernment("provincialhealthdepartments")shallberesponsiblefordeveloping,issuing,andfilinglocalfoodsafetystandards.Article4Foodsafetystandardsshallbedevelopedinordertoprotectpublichealth,bebasedonfoodsafetyriskassessmentresults,andbescientific,reasonable,safe,andreliable.Article5Thedevelopmentofnationalfoodsafetystandardsshallincludebutnotbelimitedtoplanning,scheduling,initiationofdevelopment,drafting,requestingcomments,examination,approval,issuance,aswellasfollow-upevaluation,revision,andamendment.Article6TheNHCshallformaReviewCommitteeforNationalFoodSafetyStandards("ReviewCommitteen)toberesponsibleforexaminingnationalfoodsafetystandardsandprovidingadvisoryopinionsontheworkofnationalfoodsafetystandards,amongothers.Thereviewcommitteeconsistsofprofessionalcommittees,thechieftechnicalofficer,alegalityreviewworkgroup,thesecretariat,andtheofficeofthesecretariat.Article7Theissuednationalfoodsafetystandardsfallunderscientificandtechnologicalachievementsandthemaindraftersofthestandardsmaybegivenincentivesinaccordancewiththerelevantprovisionsissuedbythestate.第四条制定食品安全标准 应当以保障公众身体健康为宗 旨，以食品安全风险评估结果为 依据，做到科学合理、安全可 靠。第五条食品安全国家标准 制定工作包括规划、计划、立 项、起草、征求意见、审查、批 准、公布以及跟踪评价、修订、 修改等。第六条国家卫生健康委组 织成立食品安全国家标准审评委 员会（以下简称审评委员会）， 负责审查食品安全国家标准，对 食品安全国家标准工作提供咨询 意见等。审评委员会设专业委员会、技术 总师、合法性审查工作组、秘书 处和秘书处办公室。第七条公布的食品安全国 家标准属于科技成果，可以按照 国家有关规定对标准主要起草人 给予激励。第八条县级以上卫生健康 主管部门依职责对食品安全标准 相关工作提供人员、经费等方面 的保障。Article8Healthadministrativedepartmentsatorabovethecountylevelshallguaranteetheworkrelatingtofoodsafetystandardsinsuchaspectsaspersonnelandfundsaccordingtotheirduties.食品安全国家标准立项ChapterIlInitiationofDevelopmentofNational,一直FoodSafetyStandards-Article 9 TheNHCshall,inconjunctionwiththerelevantdepartmentsoftheStateCouncil,makeannualimplementationplansaccordingtoplansonnationalfoodsafetystandardsandshallrequestcommentsfromthepublic.Article 10 Wherearelevantdepartmentdeemsthatthedevelopmentofnationalfoodsafetystandardsisneededinthefieldsunderitssupervision,itshallofferrecommendationsoninitiatingthedevelopmentofstandardstotheNHCbeforepreparingtheannualplanforthedevelopmentofnationalfoodsafetystandards.Anycitizen,legalperson,oranyotherorganizationmayofferrecommendationsoninitiatingthedevelopmentofnationalfoodsafetystandards.Article 11 Therecommendationsoninitiatingthedevelopmentofstandardsshallincludebutnotbelimitedtomajorfoodsafetyproblemstobesolved,thebackgroundandreasonsfortheinitiationofthedevelopmentofstandards,thebasisforthemonitoringandassessmentofexistingfoodsafetyrisks,possibleeconomicandsocialimpacts,andthecandidateentitiesfordraftingstandards.Article 12 ThenationalfoodsafetystandardstobedevelopeduponrecommendationsshallcomplywithArticle26oftheFoodSafetyLawofthePeople'sRepublicofChina.第九条国家卫生健康委会 同国务院有关部门，根据食品安 全国家标准规划制定年度实施计 划，并应公开征求意见。第十条各有关部门认为本 部门负责监管的领域需要制定食 品安全国家标准的，应当在每年 编制食品安全国家标准制定计划 前，向国家卫生健康委提出立项 建议。任何公民、法人和其他组织都可 以提出食品安全国家标准立项建 议。第十一条 立项建议应当包 括：要解决的主要食品安全问 题、立项的背景和理由、现有食 品安全风险监
