专利实施强制许可办法(2012)MeasuresforCompulsoryLicenseforPatentExploitation(2012)制定机关：国家知识产权局发文字号：中华人民共和国国家知识产权局令第64号公布日期：2012.03.15施行日期：2012.05.01效力位阶：部门规章法规类别：专利管理专利实施IssuingAuthority：ChinaNationalIntellectualPropertyAdministrationDocumentNumber：OrderNo.64oftheStateIntellectualPropertyOfficeDateIssued：03-15-2012EffectiveDate：05-01-20121.evelofAuthority：DepartmentalRulesAreaofLaw：PatentManagementPatentImplementationOrderoftheStateIntellectualPropertyOffice国家知识产权局令(No. 64)（第64号）专利实施强制许可办法已经 局务会议审议通过，现予公布， 自2012年5月1日起施行。局长田力普TheMeasuresforCompulsoryLicenseforPatentExploitation,asdeliberatedandadoptedattheexecutivemeetingoftheStateIntellectualPropertyOffice,areherebypromulgatedandshallcomeintoforceonMay1,2012.DirectorGeneral:TianLipuMarch 15, 2012二。一二年三月十五日MeasuresforCompulsoryLicenseforPatentExploitationChapter I GeneralProvisionsArticle1Tostandardizethegranting,royaltydeterminationandterminationproceduresregardingcompulsorylicensefortheexploitationofinventionpatentsorutilitymodelpatents(hereinafterreferredtoas“compulsoryIicensen),theseMeasuresareformulatedinaccordancewiththePatentLawofthePeople'sRepublicChina(hereinafterreferredtoastheTatentLaw),theDetailedRulesfortheImplementationofthePatentLawofthePeople'sRepublicChinaandtherelevantlawsandregulations.Article2TheStateIntellectualPropertyOfficeshallberesponsiblefortheacceptanceandexaminationofrequestsforcompulsorylicense,requestsforroyaltydeterminationsforcompulsorylicense,andrequestsfortheterminationofcompulsorylicense,andmakingdecisionsthereon.Article3Requestsforcompulsorylicense,requestsforroyaltydeterminationsforcompulsorylicenses,andrequestsfortheterminationofcompulsorylicensesshallbehandledinwrittenformandinChinese.专利实施强制许可办法第一章总则第一条为了规范实施发明专 利或者实用新型专利的强制许可 （以下简称强制许可）的给予、 费用裁决和终止程序，根据中 华人民共和国专利法（以下简 称专利法）、中华人民共和国 专利法实施细则及有关法律法 规，制定本办法。第二条国家知识产权局负责 受理和审查强制许可请求、强制 许可使用费裁决请求和终止强制 许可请求并作出决定。第三条请求给予强制许可、 请求裁决强制许可使用费和请求 终止强制许可，应当使用中文以 书面形式办理。依照本办法提交的各种证件、证明文件是外文的，国家知识产权局认为必要时，可以要求当事人在指定期限内附送中文译文；期WhereanycertificateorcertificationdocumentsubmittedinaccordancewiththeseMeasuresisinaforeignlanguage,theStateIntellectualPropertyOfficemay,whenitdeemsnecessary,requirethepartytosubmitaChinesetranslationofthecertificateorcertificationdocumentwithinaspecifiedtimelimit;wherethetranslationisnotsubmittedwithinthespecifiedtimelimit,thecertificateorcertificationdocumentshallbedeemedtohavenotbeensubmitted.Article4Tohandlecompulsorylicensingmatters,aforeigner,aforeignenterpriseoranyotherforeignorganizationthathasnoregularresidenceorplaceofbusinessinChinashallentrustalegallyformedpatentagencytohandletherelevantmatters.Apartythatentrustsapatentagencytohandlecompulsorylicensingmattersshallsubmitapowerofattorney,indicatingthescopeofthepowerentrusted.Whereinonepartytherearetwoormoremembersandnoneofthemhasentrustedapatentagency,unlessotherwisestated,thefirstmemberdesignatedinthesubmittedwrittendocumentsshallbedeemedastherepresentativeofthisparty.Chapter II PresentationandAcceptanceofRequestsforCompulsoryLicense满未附送的，视为未提交该证 件、证明文件。第四条 在中国没有经常居所 或者营业所的外国人、外国企业 或者外国其他组织办理强制许可 事务的，应当委托依法设立的专 利代理机构办理。当事人委托专利代理机构办理强 制许可事务的，应当提交委托 书，写明委托权限。一方当事人 有两个以上且未委托专利代理机 构的，除另有声明外，以提交的 书面文件中指明的第一当事人为 该方代表人。第二章 强制许可请求的提出与 受理第五条 专利权人自专利权被 授予之日起满3年，且自提出专 利申请之日起满4年，无正当理 由未实施或者未充分实施其专利 的，具备实施条件的单位或者个 人可以根据专利法第四十八条第 一项的规定，请求给予强制许 可。Article5Whereithasbeenthreeyearssincethedatethepatentrightwasgrantedandfouryearssincethedatethepatentapplicationwassubmitted,andthepatentee,withoutanyjustifiablereason,failstohavethepatentexploitedorfullyexploited,anentityorindividualthatsatisfiestheconditionsforpatentexploitationmayrequestacompulsorylicenseinaccordancewiththeprovisionsofArticle48(1)ofthePatentLaw.Wherethepatentee'sexerciseofthepatentrightisconfirmedasmonopolisticbehaviorpursuanttolaw,forthepurposeofeliminatingorreducingthemonopolisticbehavior,snegativeimpactoncompetition,anentityorindividualsatisfyingtheconditionsforpatentexploitationmayrequestacompulsorylicenseinaccordancewiththeprovisionsofArticle48(2)ofthePatentLaw.Article6Whereanationalemergencyoranyextraordinaryaffairoccurs,orwherethepublicinterestsorequires,therelevantcompetentdepartmentoftheStateCouncilmay,inaccordancewiththeprovisionsofArticle49ofthePatentLaw,recommendthattheStateIntellectualPropertyOfficegrantacompulsorylicensetoadesignatedentitysatisfyingtheconditionsforpatentexploitation.Article7Forthepurposeofpublichealth,anentitysatisfyingtheconditionsforpatentexploitationmay,inaccordancewiththeprovisionsofArticle50ofthePatentLaw,requestacompulsorylicenseforthemanufactureofadrugforwhichapatentrighthasbeenobtained,andwhichisexportedtothefollowingcountriesorregions:1. aleastdevelopedcountryorregion;or2. adevelopedordevelopingcountrythatisaWTOmemberandthatnotifiestheWTOandexpressesitsdesiretobeanimporterinaccordancewiththerelevantinternationaltreaty.专利权人行使专利权的行为被依 法认定为垄断行为的，为消除或 者减少该行为对竞争产生的不利 影响，具备实施条件的单位或者 个人可以根据专利法第四十八条 第二项的规定，请求给予强制许 可。第六条在国家
