民用无人驾驶航空器生产管理若 干规定（2023年12月18日工业和信息 化部令第66号公布，自2024年1 月1日起施行）第一条为了规范民用无人 驾驶航空器生产活动，促进民用 无人驾驶航空器产业健康有序发 展，维护航空安全、公共安全、 国家安全，根据无人驾驶航空 器飞行管理暂行条例以及相关 法律、行政法规，制定本规定。第二条生产、组装、拼装 （以下统称生产）在中华人民共 和国境内销售、使用的民用无人 驾驶航空器，应当遵守本规定。民用无人驾驶航空器生产管理若干规定SeveralProvisionsontheAdministrationoftheManufactureofUnmannedCivilAircraft制定机关：工业和信息化部发文字号：工业和信息化部令第66号公布日期：2023.12.18施行日期：2024.01.01效力位阶：部门规章法规类别：航空运输IssuingAuthority:MinistryofIndustry&InformationTechnologyDocumentNumber:OrderNo.66oftheMinistryofIndustryandInformationTechnologyDateIssued:12-18-2023EffectiveDate:01-01-20241.evelofAuthority:DepartmentalRulesAreaofLaw:AirTransportSeveralProvisionsontheAdministrationoftheManufactureofUnmannedCivilAircraft(IssuedbyOrderNo.66oftheMinistryofIndustryandInformationTechnologyonDecember18,2023,andcomingintoforceonJanuary1,2024)Article1TheseProvisionsaredevelopedinaccordancewiththeInterimRegulationontheAdministrationoftheFlightofUnmannedAircraftandotherapplicablelawsandadministrativeregulationsforthepurposesofregulatingthemanufacturingactivitiesofunmannedcivilaircraft,promotingthesoundandorderlydevelopmentoftheunmannedcivilaircraftindustry,andprotectingaviationsafety,publicsafety,andnationalsecurity.Article2Themanufacture,assembly,andfabrication(hereinaftercollectivelyreferredtoas“manufacture")ofunmannedcivilaircraftforsaleorusewithintheterritoryofthePeople'sRepublicofChinashallcomplywiththeseProvisions.ForthepurposesoftheseProvisions,“unmannedcivilaircrafmeansacivilaircraftwithoutahumanpilotaboardbutwithanindependentpowertrain.Article3Anunmannedcivilaircraftmanufacturershallassignauniqueproductidentificationnumbertoeachunmannedcivilaircraftitmanufactures,exceptforflyingtoyswithanindependentpowertrain.Article4Auniqueproductidentificationnumbershallcontainthenamecodeoftheunmannedcivilaircraftmanufacturer,theproductmodelcode,andtheserialnumber.ThenamecodeoftheunmannedcivilaircraftmanufacturerandtheproductmodelcodeshallbepreparedbytheunmannedcivilaircraftmanufacturerandreportedtotheMinistryofIndustryandInformationTechnologyforexaminationandconfirmation.Theserialnumbershallbepreparedbytheunmannedcivilaircraftmanufactureronitsown.Article5Thecodingrulesofuniqueproductidentificationcodesshallcomplywiththemandatoryrequirementsoftherelevantnationalstandards.本规定所称民用无人驾驶航空 器，是指没有机载驾驶员、自备 动力系统的民用航空器。第三条民用无人驾驶航空 器生产者应当为其生产的民用无 人驾驶航空器设置唯一产品识别 码。自备动力系统的飞行玩具除 外。第四条 唯一产品识别码应 当包含民用无人驾驶航空器生产 者名称代码、产品型号代码和序 列号。民用无人驾驶航空器生产者名称 代码、产品型号代码，由民用无 人驾驶航空器生产者拟制，报工 业和信息化部审核确认。序列号由民用无人驾驶航空器生 产者自行编制。第五条唯一产品识别码的 编码规则应当符合有关国家标准 的强制性要求。不得重复、虚假设置唯一产品识 别码。Nouniqueproductidentificationnumbershallbeassignedrepeatedlyorfalsely.Article6AnunmannedcivilaircraftmanufacturershallfiletheuniqueproductidentificationcodeinformationwiththeMinistryofIndustryandInformationTechnologyforrecordationbeforetheunmannedcivilaircraftisputonthemarket.However,foranunmannedcivilaircraftthatisusedfortestflightsorthatisfabricatedorassembled,theuniqueproductidentificationcodeinformationshallbefiledwiththeMinistryofIndustryandInformationTechnologyforrecordationbeforeitsfirstflight.Article7Whereanunmannedcivilaircraftmanufacturerchangesanyuniqueproductidentificationcodeduetorepairormaintenance,themanufacturershallfilethechangeoftheuniqueproductidentificationcodewiththeMinistryofIndustryandInformationTechnologyforrecordationbeforetherelevantunmannedcivilaircraftfliesagain.Article8Anunmannedcivilaircraftmanufacturershallcomplywiththelawsandregulationsontheadministrationofradioandtherelevantprovisionsissuedbythestateontheadministrationofradio.Exceptformicropower,short-rangeradiotransmissionequipment,theradiotransmissionequipmentofunmannedcivilaircraftshallobtainmodelapprovalofradiotransmissionequipment.第六条民用无人驾驶航空 器生产者应当在民用无人驾驶航 空器投放市场前，将唯一产品识 别码信息报工业和信息化部备 案，但用于测试飞行以及组装、 拼装的民用无人驾驶航空器，应 当在首次飞行前将唯一产品识别 码信息报工业和信息化部备案。第七条因维修、维护等原 因，民用无人驾驶航空器生产者 变更唯一产品识别码的，应当在 民用无人驾驶航空器重新飞行前 将唯一产品识别码变更情况报工 业和信息化部备案。第八条生产民用无人驾驶 航空器应当遵守无线电管理法律 法规以及国家无线电管理有关规 定。除微功率短距离无线电发射 设备外，民用无人驾驶航空器无 线电发射设备应当依法取得无线 电发射设备型号核准。第九条民用无人驾驶航空 器装载的接入公用电信网的电信 设备应当依法取得电信设备进网 许可。Article9Anytelecommunicationsequipmentloadedonanunmannedcivilaircraftforaccesstothepublictelecommunicationsnetworkshallobtainanetworkaccesslicensefortelecommunicationsequipmentinaccordancewiththelaw.Article10Anunmannedcivilaircraft第十条民用无人驾驶航空器生产者不得在民用无人驾驶航 空器中设置恶意程序；发现民用 无人驾驶航空器存在网络或者数 据安全缺陷、漏洞等风险时，应 当立即采取补救措施，按照国家 有关规定及时告知使用人，并向 住所地的县级以上地方人民政府 工业和信息化主管部门或者省级 通信主管部门报告。manufacturershallnotinstallmalwareinitsunmannedcivilaircraft.Whenamanufacturerdiscoversanyrisksuchascybersecurityordatasecuritydefectandvulnerabilityarisingfromitsunmannedcivilaircraft,itshallimmediatelytakeremedialmeasures,promptlyinformusersinaccordancewiththeapplicableprovisionsissuedbythestate,andfileareportwiththedepartmentofindustryandinformationtechnologyofthepeople,sgovernmentatorabovethecountylevelortheprovincialcommunicationdepartmentatitsdomicile.国家鼓励民用无人驾驶航空器生 产者依法使用商用密码等技术手 段保护网络与信息安全。Thestateencoura
