建设工程消防设计审查验收管 理暂行规定（2020年4月1日住房和城乡 建设部令第51号公布，根据 2023年8月21日住房和城乡 建设部令第58号修正）第一章总则第一条为了加强建设工 程消防设计审查验收管理，保 证建设工程消防设计、施工质 量，根据中华人民共和国建建设工程消防设计审查验收管理暂行规定(2023修正)InterimProvisionsontheAdministrationofFireProtectionDesignReviewandFinalInspectionofConstructionProjects(2023Amendment)制定机关：住房和城乡建设部发文字号：中华人民共和国住房和城乡建设部令第58号公布日期：2023.08.21施行日期：2023.10.30效力位阶：部门规章法规类别：建设综合规定IssuingAuthority：MinistryofHousing&Urban-RuralDevelopmentDocumentNumber：OrderNo.582023oftheMinistryofHousing&Urban-RuralDevelopmentDateIssued：08-21-2023EffectiveDate:10-30-20231.evelofAuthority:DepartmentalRulesAreaofLaw:GeneralProvisionsonConstructionInterimProvisionsontheAdministrationofFireProtectionDesignReviewandFinalInspectionofConstructionProjects(PromulgatedbyOrderNo.51oftheMinistryofHousingandUrban-RuralDevelopmentofthePeople'sRepublicofChinaonApril1,2020andamendedinaccordancewithOrderNo.58oftheMinistryofHousingandUrban-RuralDevelopmentonAugust21,2023)ChapterIGeneralProvisionsArticle1Forthepurposesofstrengtheningtheadministrationoffireprotectiondesignreviewandfinalinspectionofconstructionprojectsandensuringthefireprotectiondesignandconstructionqualityofconstructionprojects,theseProvisionsareformulatedinaccordancewiththeConstructionLawofthePeople'sRepublicofChina,theFireProtectionLawofthePeople'sRepublicofChina,theRegulationontheQualityManagementofConstructionProjectsandotherlawsandregulations.Article2TheseProvisionsshallapplytothefireprotectiondesignreviewandfireprotectionfinalinspectionofspecialconstructionprojectsaswellastherecordationandthefireprotectionfinalinspectionrecordation(hereinafterreferredtoasurecordation)andrandominspectionofotherconstructionprojects.ForthepurposeoftheseProvisions,"specialconstructionprojectsnmeanstheconstructionprojectslistedinArticle14oftheseProvisions.ForthepurposeoftheseProvisions,uotherconstructionprojectsnmeanstheconstructionprojects,otherthanspecialconstructionprojects,requiringfireprotectiondesignsinaccordancewiththenationaltechnicalstandardsoffireprotectionforconstructionprojects.Article3Thecompetentdepartmentofhousingandurban-ruralconstructionoftheStateCouncilshallberesponsibleforguidingandsupervisingthefireprotectiondesignreviewandfinalinspectionofconstructionprojectsnationwide.筑法中华人民共和国消防 法建设工程质量管理条 例等法律、行政法规，制定 本规定。第二条特殊建设工程的 消防设计审查、消防验收，以 及其他建设工程的消防验收备 案（以下简称备案）、抽查， 适用本规定。本规定所称特殊建设工程，是 指本规定第十四条所列的建设 工程。本规定所称其他建设工程，是 指特殊建设工程以外的其他按 照国家工程建设消防技术标准 需要进行消防设计的建设工 程。第三条国务院住房和城 乡建设主管部门负责指导监督 全国建设工程消防设计审查验 收工作。县级以上地方人民政府住房和 城乡建设主管部门（以下简称 消防设计审查验收主管部门） 依职责承担本行政区域内建设 工程的消防设计审查、消防验 收、备案和抽查工作。Thecompetentdepartmentofhousingandurban-ruraldevelopmentofthelocalpeople'sgovernmentatorabovethecountylevel(hereinafterreferredtoasthe“competentdepartmentoffireprotectiondesignreviewandfinalinspection)shallundertakethefireprotectiondesignreview,fireprotectionfinalinspection,recordationandrandominspectionofconstructionprojectswithintheirrespectiveadministrativeregions.Thedepartmentinchargeoffireprotectiondesignreview,fireprotectionfinalinspection,recordationandrandominspectionofaconstructionprojectacrossadministrativeregionsshallbedesignatedbythecommoncompetentdepartmentofatthenexthigherlevelofthecompetentdepartmentoffireprotectiondesignreviewandfinalinspectionintheadministrativeregionswheretheconstructionprojectislocated.Article4ThecompetentdepartmentoffireprotectiondesignreviewandfinalinspectionshallutilizeinformationtechnologysuchasInternettechnologytoconductfireprotectiondesign,fireprotectionfinalinspection,recordationandrandominspection,establishandimproveacreditmanagementsystemforrelevantentitiesandtheiremployees,andcontinuouslyenhancethelevelofgovernmentservices.Article5Theexpensesrequiredinthefireprotectiondesign,fireprotectionfinalinspection,recordationandrandominspectionconductedbythecompetentdepartmentoffireprotectiondesignreviewandfinalinspectionshallbegovernedbytheprovisionsoftheAdministrativeLicenseLawofthePeople'sRepublicofChinaandotherrelevantlawsandregulations.跨行政区域建设工程的消防设 计审查、消防验收、备案和抽 查工作，由该建设工程所在行 政区域消防设计审查验收主管 部门共同的上一级主管部门指 定负责。第四条 消防设计审查验 收主管部门应当运用互联网技 术等信息化手段开展消防设计 审查、消防验收、备案和抽查 工作，建立健全有关单位和从 业人员的信用管理制度，不断 提升政务服务水平。第五条消防设计审查验 收主管部门实施消防设计审 查、消防验收、备案和抽查工 作所需经费，按照中华人民 共和国行政许可法等有关法 律法规的规定执行。第六条消防设计审查验 收主管部门应当及时将消防验 收、备案和抽查情况告知消防 救援机构，并与消防救援机构 共享建筑平面图、消防设施平 面布置图、消防设施系统图等Article6Thecompetentdepartmentoffireprotectiondesignreviewandfinalinspectionshallpromptlyinformthefireandrescuedepartmentsoftheinformationonfireprotectionfinalinspection,recordationandrandominspection,andsharematerialssuchasthebuildingplans,firefacilitylayoutplans,andfirefacilitysystemdrawingswiththefireandrescuedepartments.资料。Article7Staffmembersengagedinthefireprotectiondesignreviewandfinalinspectionofconstructionprojectsaswellasemployeesofentitiessuchasconstructionentities,designentities,constructioncontractors,projectsupervisionentities,andtechnicalserviceprovidersshallhavethecorrespondingprofessionaltechnicalcapabilities,andattendvocatio
