上海市水产品质量安全监督管理办法ProceduresofShanghaiMunicipalityontheSupervisionandAdministrationoftheQualityandSafetyofAquaticProducts制定机关：上海市人民政府发文字号：上海市人民政府令第66号公布日期：2022.02.17施行日期：2022.05.01效力位阶：地方政府规章法规类别：水产品IssuingAuthority：ShanghaiMunicipalPeople'sGovernmentDocumentNumber：DecreeNo.66ofShanghaiMunicipalPeople'sGovernmentDateIssued：02-17-2022EffectiveDate：05-01-20221.evelofAuthority：LocalGovernmentRulesAreaofLaw：AquaticProductsDecreeofShanghaiMunicipalPeople'sGovernment上海市人民政府令No.66（第66号）ProceduresofShanghaiMunicipalityontheSupervisionandAdministrationoftheQualityandSafetyofAquaticProductswereadoptedatthe157thRoutineMeetingoftheMunicipalPeople'sGovernmentonFebruary8,2022,andareherebypromulgated.TheyshallbeeffectiveasofMay1,2022.上海市水产品质量安全监督管理办法已经2022年2月8日市政府第157次常务会议通过，现予公布，自2022年5月1日起施行。Mayor:GongZheng市长龚正February17,20222022年2月17日ProceduresofShanghaiMunicipalityontheSupervisionandAdministrationoftheQualityandSafetyofAquaticProducts上海市水产品质量安全监督管理办法(PromulgatedbyDecreeNo.66ofShanghaiMunicipalPeople'sGovernmentonFebruary8,2022;effectiveasofMay1,2022)（2022年2月17日上海市人民政府令第66号公布自2022年5月1日起施行）ChapterIGeneralProvisions第一章总则Article1(PurposesandBasis)第一条（目的和依据）Withaviewtostrengtheningthesupervisionandadministrationofthequalityandsafetyofaquaticproducts,ensuringthequalityandsafetyofaquaticproductsandmaintainingthehealthandlifesafetyofthepublic,theseProceduresareformulatedaccordingtotheLawofthePeople'sRepublicofChinaonFoodSafety,theLawofthePeople'sRepublicofChinaontheQualityandSafetyofAgriculturalProducts,theRegulationsofShanghaiMunicipalityonFoodSafety,andotherrelevantlaws,rulesandregulations,andinthelightoftheactualcircumstancesofthisMunicipality.为了加强水产品质量安全监督管理，保障水产品质量安全，维护公众的身体健康和生命安全，根据中华人民共和国食品安全法中华人民共和国农产品质量安全法上海市食品安全条例等法律、法规，结合本市实际，制定本办法。Article2(ApplicationScopeandDefinition)第二条（适用范围和定义）本市行政区域内水产品生产、经 营及其相关监督管理活动，适用 本办O本办法所称水产品，是指可供人TheseProceduresshallapplytotheproductionandbusinessoperationofaquaticproductsandtherelevantsupervisionandadministrationactivitieswithintheadministrativeareaofthisMunicipality.Theaquaticproductsmentionedinthese食用的水生动物、植物、微生物 及其初级产品。初级产品，是指 经过分拣、去皮、剥壳、干燥、 清洗、切割、冷冻、分级、包装 等加工，但未改变其基本自然性 状和化学性质的产品。Proceduresrefertotheaquaticanimals,plants,microorganismsandtheirprimaryproductsedibletohumanbeings.Theprimaryproductsmeantheproductsthathavebeensorted,peeled,shelled,dried,cleaned,cut,frozen,graded,packed,orprocessedinotherways,butwithoutchangingtheirbasicnaturaltraitsorchemicalproperties.第三条（生产经营者责 任）Article 3 (ResponsibilityofProducersandBusinessOperators)水产品生产经营者对其生产、经 营的水产品质量安全负责。水产 品生产经营者应当依法从事生 产、经营活动，执行水产品质量 安全相关标准，接受社会监督， 承担社会责任。Theproducersandbusinessoperatorsofaquaticproductsshallberesponsibleforthequalityandsafetyoftheaquaticproductsproducedoroperatedthereby.Theproducersandbusinessoperatorsofaquaticproductsshallengageintheproductionandbusinessactivitiesaccordingtolaw,implementrelevantstandardsforqualityandsafetyofaquaticproducts,acceptthepublicsupervisionandbearthesocialresponsibilities.第四条（政府职责）Article 4 (GovernmentDuties)市、区人民政府对本行政区域内 水产品质量安全监督管理工作负 责，统一领导、组织、协调水产 品质量安全监督管理工作以及水 产品质量安全突发事件应对工 作，建立健全水产品质量安全全 程监督管理工作机制和信息共享 机制。Themunicipalanddistrictpeople'sgovernmentsshallberesponsibleforthesupervisionandadministrationofaquaticproducts*qualityandsafetywithintheirownrespectiveadministrativeareas;lead,organizeandcoordinatethesupervisionandadministrationofaquaticproducts'qualityandsafetyandtheresponsetotheemergenteventsofaquaticproducts*qualityandsafety;andestablishandperfectaworkingmechanismandaninformationsharingmechanismforthewhole-processsupervisionandadministrationofaquaticproducts'qualityandsafety.区人民政府应当依照国家和本市 有关规定，明确乡、镇人民政府 和街道办事处的水产品质量安全 管理职责，督促、指导乡、镇人 民政府和街道办事处做好水产品 质量安全日常工作，形成工作合 力。第五条（食品药品安全委 员会及其办公室职责）市、区人民政府设立的食品药品 安全委员会依法履行研究部署、 统筹指导水产品质量安全工作等 职责。市、区食品药品安全委员会下设 办公室，办公室设在同级市场监 管部门，负责辖区内水产品质量 安全综合协调、监督考评、应急 管理等工作，承担委员会在水产 品质量安全方面的日常工作。乡、镇人民政府和街道办事处建 立的食品安全综合协调机构，负 责做好辖区内水产品质量安全综 合协调、隐患排查、信息报告、Thedistrictpeople'sgovernmentshall,accordingtotherelevantprovisionsoftheStateandthisMunicipality,definethefunctionsanddutiesofthetown/townshippeople'sgovernmentandthesub-districtofficefortheadministrationofaquaticproducts'qualityandsafety,urgeandguidethetown/townshippeople'sgovernmentandthesub-districtofficetoensuretheroutineworkofaquaticproducts,qualityandsafetyiswelldone,soastoformajointforceinthework.Article 5 (FunctionsandDutiesofFoodandDrugSafetyCommissionandItsSubordinateOffice)Thefoodanddrugsafetycommissionsestablishedbythemunicipalanddistrictpeople'sgovernmentsshall,inaccordancewithlaw,performthefunctionsanddutiesofstudying,arranging,overallplanningandguidingtheworkofaquaticproducts'qualityandsafety.Themunicipalanddistrictfoodanddrugsafetycommissionsshallhaveoffices,whichshallbefixedinthemarketregulationdepartmentatthes
