中华人民共和国船舶和海上设施检 验条例（1993年2月14日中华人民共和 国国务院令第109号发布根据 2019年3月2 0国务院关于修改 部分行政法规的决定修订）第一章总则第一条为了保证船舶、海上 设施和船运货物集装箱具备安全航 行、安全作业的技术条件，保障人中华人民共和国船舶和海上设施检验条例(2019修订)RegulationsofthePeople,sRepublicofChinaGoverningSurveyofShipsandOffshoreInstallations(2019Revision)制定机关：国务院发文字号：中华人民共和国国务院令第709号公布日期：2019.03.02施行日期：2019.03.02效力位阶：行政法规法规类别：船舶IssuingAuthority：StateCouncilDocumentNumber：OrderNo.709oftheStateCouncilofthePeople'sRepublicofChinaDateIssued：03-02-2019EffectiveDate:03-02-20191.evelofAuthority：AdministrativeRegulationsAreaofLaw：VesselsRegulationsofthePeople,sRepublicofChinaGoverningSurveyofShipsandOffshoreInstallations(PromulgatedbyOrderNo.109oftheStateCouncilofthePeople,sRepublicofChinaonFebruary14,1993;andrevisedinaccordancewiththeDecisionoftheStateCounciltoAmendCertainAdministrativeRegulationsonMarch2,2019)Chapter I: GeneralProvisions(1) icle1TheseRegulationsareformulatedtoensurethatships,offshoreinstallationsandsea-bornecargocontainersshallmeetthetechnicalrequirementsforsafenavigationandoperation,tosafeguardthesafetyofhumanlifeandpropertyandtopreventthepollutionofmarineenvironment.(2) icle2TheseRegulationsshallapplyto:(3) shipsregisteredortoberegisteredinthePeople'sRepublicofChina(hereinafterreferredtoas"Chineseflagships");(4) foreignflagshipsapplyingforsurveyaccordingtotheseregulationsorotherrelevantprovisionsissuedbytheState;(5) offshoreinstallationslocatedortobelocatedincoastalwatersofthePeole,sRepublicofChina(hereinafterreferredtoas"offshoreinstallations1,);and(6) sea-bornecargocontainersownedbyanenterpriseaslegalpersonregisteredinthePeoplesRepublicofChina(hereinafterreferredtoas"containers").Article3TheRegisterofShippingofthePeople'sRepublicofChina(hereinafterreferredtoas,theRegisterofShipping'*)isthecompetentauthoritytocarryoutsurveysofvariouskindsinaccordancewiththeseRegulations.民生命财产的安全和防止水域环境 污染，制定本条例。第二条本条例适用于:（一）在中华人民共和国登记或者 将在中华人民共和国登记的船舶（以下简称中国籍船舶）；（二）根据本条例或者国家有关规 定申请检验的外国籍船舶；（三）在中华人民共和国沿海水域 内设置或者将在中华人民共和国沿 海水域内设置的海上设施（以下简 称海上设施）；（四）在中华人民共和国登记的企 业法人所拥有的船运货物集装箱 （以下简称集装箱）。第三条 中华人民共和国船舶 检验局（以下简称船检局）是依照 本条例规定实施各项检验工作的主 管机构。经国务院交通主管部门批准，船检 局可以在主要港口和工业区设置船 舶检验机构。Withtheapprovalofthedepartmentin-chargeofcommunicationsundertheStateCouncil,theRegisterofShippingmayestablishshipsurveyorganizationsinmajorportsandindustrialareas.Withtheapprovalofthedepartmentin-chargeofcommunicationsundertheStateCouncilandofthepeople'sgovernmentsofprovinces,autonomousregionsormunicipalitiesdirectlyundertheCentralGovernment,thedepartmentsin-chargeofcommunicationsunderthepeople'sgovernmentsofprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernmentmayestablishlocalship-surveyorganizationsinportsintheirrespectivejurisdictions.Article4ChinaClassificationSocietyisapublicorganizationwhichundertakesclassificationsurveys,certificationsurveysandsurveysrelatedtonotarymattersofdomesticandforeignships,offshoreinstallationsandcontainers.TheSocietymayconductstatutorysurveysonbehalfoftheRegisterofShippingsubjecttothelatter,sauthorization.Article5InconductingallsurveyssetforthintheseRegulationstheprincipleofsafetyfirstandqualityfirstshallbeimplementedandthedevelopmentandapplicationofthelatesttechnologyshallbeencouraged.Chapter II: SurveyofShips经国务院交通主管部门和省、自治 区、直辖市人民政府批准，省、自 治区、直辖市人民政府交通主管部 门可以在所辖港口设置地方船舶检 验机构。第四条中国船级社是社会团 体性质的船舶检验机构，承办国内 外船舶、海上设施和集装箱的入级 检验、鉴证检验和公证检验业务； 经船检局授权，可以代行法定检 验。第五条实施本条例规定的各 项检验，应当贯彻安全第一、质量 第一的原则，鼓励新技术的开发和 应用。第二章船舶检验Article 6 Surveysofshipsshallbecarriedout第六条bythefollowingorganizationsrespectively:机构实施：船舶检验分别由下列(1) ship-surveyorganizationsestablishedbytheRegisterofShipping;（一）船检局设置的船舶检验机 构；（二）省、自治区、直辖市人民政 府交通主管部门设置的地方船舶检(2) localship-surveyorganizationsestablishedbythedepartmentsinchargeofcommunicationsunderthePeople's验机构;governmentsofprovinces,autonomousregionsandmunicipalitiesdirectlyundertheCentralGovernment;(3) ship-surveyorganizationsentrusted,designated,orapprovedbytheRegisterofShipping.Theabove-mentionedorganizationsarehereinaftergenerallyreferredtoasship-surveyorganizations.Article 7 OwnersoroperatorsofChineseflagshipsmustapplytoaship-surveyorganizationfor:(1) constructionsurveyfortheirshipsthatareunderconstructionorconversion;(2) periodicalsurveyfortheirshipsthatareinservice;(3) initialsurveyfortheirforeignflagshipsbeingtransferredintoChinesenationality.Article 8 Importantequipment,partsandmaterialsusedbyChineseflagshipsforsafetyofnavigationatseaandforthepreventionofpollutionofmarineenvironmentshallbesubjecttosurveysbytheship-surveyorganizationsinaccordancewiththerelevantprovisions.（三）船检局委托、指定或者认可 的检验机构。前款所列机构，以下统称船舶检验 机构。第七条中国籍船舶的所有人 或者经营人，必须向船舶检验机构 申请下列检验：（一）建造或者改建船舶时，申请 建造检验；（二）营运中的船舶，申请定期检 验；（三）由外国籍船舶改为中国籍船舶的，申请初次检验。第八条中国籍船舶所使用的 有关海上交通安全的和防止水域环 境污染的重要设备、部件和材料， 须经船舶检验机构按照有关规定检 验。第九条中国籍船舶须由船舶 检验机构测定总吨位和净吨位，核Article 9 Chineseflagshipsshallbesubjecttotonnagemeasurementincludinggrosstonnageandnettonnagemeasurements,aswellasverificationandapprov
