RegulationontheAdministrationofCommercialPerformances(2020Revision)DocumentNumber：OrderNo.732oftheStateCouncilofthePeople'sRepublicofChinaAreaofLaw:Show1.evelofAuthority：AdministrativeRegulationsIssuingAuthority：StateCouncilDateIssued：11-29-2020EffectiveDale11-29-2020Status:EffectivePkuIawNote:OfficialReplyoftheStateCouncilonApprovingtheInterimAdjustmentoftheImplementationofRelevantAdministrativeRegulationsandtheDepartmentalRulesApprovedbytheStateCouncilinBeijingMunicipality(2021)(Issuedon10-08-2021Effectiveon10-08-2021)2016-2020AnnotationVersion2013-2016AnnotationVersion2008-2013AnnotationVersion2005-2008AnnotationVersion1997-2005ComparisonVersionRegulationontheAdministrationofCommercial营业性演出管理条例Performances(PromulgatedbyOrderNo.439oftheStateCouncilofthePeople'sRepublicofChinaonJuly7,2005;revisedforthefirsttimeinaccordancewiththeDecisionoftheStateCouncilonAmendingtheRegulationontheAdministrationofCommercialPerformancesonJuly22,2008;andrevisedforthesecondtimeinaccordancewiththeDecisionoftheStateCouncilonAbolishingandAmendingSomeAdministrativeRegulationsonJuly18,2013;revisedforthethirdtimeinaccordancewiththeDecisionoftheStateCouncilonAmendingSomeAdministrativeRegulationsonFebruary6,2016;andrevisedforthefourthtimeinaccordancewiththeDecisionoftheStateCounciltoAmendandRepealCertainAdministrativeRegulationsonNovember29,2020)（2005年7月7日中华人民共和国国务院令第439号公布根据2008年7月22日国务院关于修改营业性演出管理条例的决定第一次修订根据2013年7月18日国务院关于废止和修改部分行政法规的决定第二次修订根据2016年2月6日国务院关于修改部分行政法规的决定第三次修订根据2020年11月29日国务院关于修改和废止部分行政法规的决定第四次修订）第一章总则ChapterIGeneralProvisionsArticle 1 ThisRegulationisformulatedwithaviewtostrengtheningthemanagementofcommercialperformances,promotingthedevelopmentofculturalindustry,boostingthesocialistartcause,cateringtotheculturalneedsofthepeopleandpromotingthesocialistspiritualcivilization.Article 2 The"commercialperformances"asmentionedinthisRegulationrefertotheliveartperformancesgearedtowardsthegeneralpublicforcommercialpurposes.Article 3 Thecommercialperformancesshalladheretothedirectionofservingthepeopleandthesocialism,giveprioritytothesocialbenefits,harmonizethesocialandeconomicbenefitsandenrichtheculturallifeofthepeople.Article 4 Thestateencouragestheexcellentprogramsthatunifytheculturalandartisticperformancegroups,creationofperformersaswellasthespiritsandartisticqualityofperformances,reflectthegoodnationalculturaltraditionandarepopularamongthepeople,andencouragestheperformancesthataregratuitouslyorpreferentiallyofferedtoruralareas,industrialandminingenterprises,aswellasthechildren.Article 5 ThecultureadministrativedepartmentoftheStaleCouncilshallberesponsibleforthesupe,isionandmanagementofthecommercialperformancesthroughoutthecountry.Thepublicsecuritydepartmentandtheindustryand第一条为了加强对营业性演出的管理，促进文化产业的发展，繁荣社会主义文艺事业，满足人民群众文化生活的需要，促进社会主义精神文明建设，制定本条例。第二条本条例所称营业性演出，是指以营利为目的为公众举办的现场文艺表演活动。第三条营业性演出必须坚持为人民服务、为社会主义服务的方向，把社会效益放在首位、实现社会效益和经济效益的统一，丰富人民群众的文化生活。第四条国家鼓励文艺表演团体、演员创作和演出思想性艺术性统一、体现民族优秀文化传统、受人民群众欢迎的优秀节目，鼓励到农村、工矿企业演出和为少年儿童提供免费或者优惠的演出。第五条国务院文化主管部门主管全国营业性演出的监督管理工作。国务院公安部门、工商行政管理部门在各自职责范围内，主管营业性演出的监督管理工作。commerceadministrativedepartmentoftheStateCouncilshall,accordingtotheirrespectivefunctions,beresponsibleforthesupen,isionandmanagementofthecommercialperformances.县级以上地方人民政府文化主管部门负责本行政区域内营 业性演出的监督管理工作。县级以上地方人民政府公安部 门、工商行政管理部门在各自职责范围内，负责本行政区 域内营业性演出的监督管理工作。Thecultureadministrativedepartmentsofthelocalpeople'sgovernmentsatorabovethecountylevelshallberesponsibleforthesupervisionandmanagementofthecommercialperformanceswithintheirrespectiveadministrativearea.Thepublicsecuritydepartmentsandtheindustryandcommerceadministrativedepartmentsofthelocalpeople'sgovernmentsatorabovethecountylevelshall,accordingtotheirrespectivefunctions,beresponsibleforthesupervisionandmanagementofcommercialperformances.第二章营业性演出经营主体的设立ChapterIIEstablishmentofBusinessSubjectofCommercialPerformances第六条文艺表演团体申请从事营业性演出活动， 应当有与其业务相适应的专职演员和器材设备，并向县级 人民政府文化主管部门提出申请；演出经纪机构申请从事 营业性演出经营活动，应当有3名以上专职演出经纪人员 和与其业务相适应的资金，并向省、自治区、直辖市人民 政府文化主管部门提出申请。文化主管部门应当自受理申 请之日起20 H内作出决定。批准的，颁发营业性演出许可 证；不批准的，应当书面通知申请人并说明理由。Article6Aculturalandartisticperformanceorganizationthatappliesforengagingincommercialperformanceactivitiesshallhavefull-timeperformersandequipmentsuitableforitsbusiness,andfileanapplicationwiththecompetentcultureadministrativedepartmentatthecountylevel;andaperformancebrokerageinstitutionthatappliesforengagingincommercialperformancebrokerageshallhavethreeormorefull-timeperformancebrokersandfundssuitableforitsbusiness,andfileanapplicationwiththecultureadministrativedepartmentofthepeople'sgovernmentoftheprovince,autonomousregionormunicipalitydirectlyundertheCentralGovernment.Thecultureadministrativedepartmentshallmakeadecisionwithin20daysofacceptingtheapplication.Iftheapplicationisapproved,acommercialperformancepermitshallbeissuedtotheapplicant;oriftheapplicationisdisapproved,theapplicantshallbenotifiedinwritingofthedecisionwithanexplanationofthereasonsforthedisapproval.第
