Regulationonthe/AdministrationofDomesticWaterTransport(2023Revision)DocumentNumber：OrderNo.764of【heStateCouncilofthePRCAreaofLaw:WaterWayTransport1.evelofAuthority：AdministrativeRegulationsIssuingAuthority：StateCouncilDateIssued：07-20-2023EffectiveDale:07-20-2023Status:Effective2017-2023AnnotationVersion2016-2017AnnotationVersion2012-2016AnnotationVersionRegulationontheAdministrationofDomesticWaterTransport(PromulgatedbytheOrderNo.625oftheStateCouncilofthePeople'sRepublicofChinaonNovember13,2012;andrevisedforthefirsttimeinaccordancewiththeDecisionoftheStaleCouncilonAmendingSomeAdministrativeRegulationsonFebruary6,2016;revisedforthesecondtimeinaccordancewiththeDecisionoftheStateCounciltoAmendandRepealCertainAdministrativeRegulationsonMarch1,2017;andrevisedforthethirdtimeinaccordancewiththeDecisionoftheStateCounciltoAmendandRepealCertainAdministrativeRegulationsonJuly20,2023)ChapterIGeneralProvisionsArticle 1 ThisRegulationisformulatedforpurposesofregulatingtheoperationofdomesticwatertransport,maintainingthemarketorderofdomesticwatertransport.国内水路运输管理条例（2012年10月13日中华人民共和国国务院令第625号公布根据2016年2月6日国务院关于修改部分行政法规的决定第一次修订根据2017年3月1日国务院关于修改和废止部分行政法规的决定第二次修订根据2023年7月20日国务院关于修改和废止部分行政法规的决定第三次修订）第一章总则第一条为了规范国内水路运输经营行为，维护国内水路运输市场秩序，保障国内水路运输安全，促进国内水路运输业健康发展，制定本条例。guaranteeingthesafetyofdomesticwatertransport,andpromotingthesounddevelopmentofdomesticwatertransportcause.Article 2 TheoperationofdomesticwatertransportandancillarybusinessshallbesubjecttothisRegulation.Theterm“domesticwatertransport(hereinafterreferredtoas4twatertransport'')asmentionedinthisRegulationreferstothecommercialtransportofpassengersandcargosinnavigablewaters,wherethedepartureport,thecallingport,andthedestinationportareallwithinthejurisdictionofthePeople'sRepublicofChina.Theterm4tancillarywatertransportbusiness“asmentionedinthisRegulationreferstothebusinessoperationsthataredirectlyprovidedforwatertransport,suchasvesselmanagement,vesselagency,agencyforwalertransportofpassengers,andagencyforwatertransportofcargos.Article 3 Thestateshallencourageandprotectfaircompetitionatthewatertransportmarketandprohibitmonopolyandunfaircompetition.Byadoptingsuchmeasuresaseconomicandtechnicalpolicies,thestateshallsupportandencouragewatertransportoperatorstorealizescaleandintensivebusinessoperationsandpromotethestructuraladjustmentofthewatertransportindustry;andsupportandencouragewatertransportoperatorstoadoptadvancedandapplicablewatertransportfacilitiesand第二条经营国内水路运愉以及水路运愉辅助业务，应当遵守本条例。本条例所称国内水路运输（以下简称水路运输），是指始发港、挂靠港和目的港均在中华人民共和国管辖的通航水域内的经营性旅客运输和货物运输。本条例所称水路运输辅助业务，是指直接为水路运输提供服务的船舶管理、船舶代理、水路旅客运输代理和水路货物运输代理等经营活动。第三条国家鼓励和保护水路运输市场的公平竞争，禁止垄断和不正当竞争行为。国家运用经济、技术政策等措施，支持和鼓励水路运输经营者实行规模化、集约化经营，促进水路运输行业结构调整；支持和鼓励水路运输经营者采用先进适用的水路运输设备和技术，保障运输安全，促进节约能源，减少污染物排放。technologiestoguaranteetransportsafety,promoteenergyconservation,andreducepollutantdischarge.Thestateshallprotectthelawfulrightsandinterestsofwatertransportoperators,passengers,andcargoowners.Article 4 ThetransportadministrativedepartmentoftheStateCouncilshallbeinchargeofthenationalwatertransportmanagement.Thetransportadministrativedepartmentunderthelocalpeople'sgovernmentatorabovethecountylevelshallbeinchargeofthewatertransportmanagementwithintheirrespectivejurisdiction.Thedepartmentorinstitutionresponsibleforwatertransportmanagementunderthelocalpeople'sgovernmentatorabovethecountylevel(hereinafterreferredtoas44departmentresponsibleforwatertransportmanagement)shallundertakethewatertransportmanagementassetforthinthisRegulation.Article 5 Toengageinwatertransportandancillarybusiness,anoperatorshallobservelawsandregulationsandprovidesen,icesingoodfaith.ThetransportadministrativedepartmentoftheStateCouncilandthedepartmentresponsibleforwatertransportmanagementshallconductsupervisionandadministrationonthewatertransportmarketaccordingtolaw,imposepenaltiesagainstanyillegalwatertransportoperationandancillarybusiness,establishmanagementrulesforoperator'soperationsingoodfaith,andpubliclyannouncethesupervisionand国家保护水路运输经营者、旅客和货主的合法权益。第四条国务院交通运输主管部门主管全国水路运输管理工作。县级以上地方人民政府交通运输主管部门主管本行政区域的水路运输管理工作。县级以上地方人民政府负责水路运输管理的部门或者机构（以下统称负责水路运输管理的部门）承担本条例规定的水路运输管理工作。第五条经营水路运输及其辅助业务，应当遵守法律、法规，诚实守信。国务院交通运输主管部门和负责水路运输管理的部门应当依法对水路运输市场实施监督管理，对水路运输及其辅助业务的违法经营活动实施处罚，并建立经营者诚信管理制度，及时向社会公告监督检查情况。第二.章水路运输经营者inspectioncircumstancesinatimelymanner.ChapterIIWaterTransportOperatorsArticle6Toapplyforengaginginwatertransportbusiness,besidesthecircumstancesasprescribedinArticle7ofthisRegulation,anapplicantshallsatisfythefollowingconditions:(1) obtainsthelegalpersonstatusasanenterprise;(2) hasvesselsthatsatisfytheconditionsasprescribedinArticle13ofthisRegulation,andthetransportcapacityofitsownvesselsconformstotheprovisionsofthetransportadministrativedepartmentoftheStateCouncil;(3) hasspecificbusinessscope.Wheretheapplicantappliesforwatertransportbusinessofpassengerliners,itshallhavefeasiblerouteoperationplan;(4) hasthemanagementpersonnelofmaritimea
