3、023)TheMeasuresfortheAdministrationoftheExpressDeliveryMarket,asadoptedatthe28thexecutivemeetingoftheMinistryofTransportonDecember8,2023,areherebyissuedandshallcomeintoforceonMarch1,2024.Minister:LiXiaopengDecember17,2023MeasuresfortheAdministrationoftheExpressDeliveryMarketChapterIGeneralProvisions

4、Article 1 TheseMeasuresaredevelopedinaccordancewiththePostalLawofthePeoplesRepublicofChina,theInterimRegulationonExpressDelivery,andotherapplicablelawsandadministrativeregulationsforthepurposesofstrengtheningthesupervisionandadministrationoftheexpressdeliverymarket,ensuringthequalityandsecurityofexp

5、ressdeliveryservices,protectingthelawfulrightsandinterestsofusers,expressdeliverypractitionersandenterprisesprovidingexpressdeliveryservices,andpromotingthesounddevelopmentoftheexpressdeliveryindustry.Article 2 TheseMeasuresshallapplytoexpressdeliverybusinessoperations,theuseofexpressdeliveryservice

6、s,andthesupervisionandadministrationoftheexpressdeliverymarketwithintheterritoryofthePeoplesRepublicofChina.Article 3 Enterprisesprovidingexpressdeliveryservicesshallcomplywithlawsandregulationsandpublicorderandgoodcustoms,conserveresourcesandprotecttheecologyandenvironmentinaccordancewiththelaw,and

7、provideuserswithrapid,accurate,safe,andconvenientexpressdeliveryservices.Article4Wheretwoormoreenterprisesprovidingexpressdeliveryservicesuseaunifiedtrademark,tradename,expresswaybills,andsupportinginformationsystem,theyshallenterintoawrittenagreementtospecifytheirrespectiverightsandobligations,obse

8、rvecommonserviceagreements,andconductunifiedmanagementinaspectssuchasservicequality,securityguarantee,businessprocess,ecologicalandenvironmentalprotection,andprotectingtherightsandinterestsofpractitioners.Theenterprisethatownsthetrademark,tradename,expresswaybills,andsupportinginformationsystemisref

9、erredtoastheheadquartersexpressdeliveryenterprise.全，维护用户、快递从业人员和经 营快递业务的企业的合法权益，促 进快递业健康发展，根据中华人 民共和国邮政法快递暂行条 例等法律、行政法规，制定本办 法。第二条在中华人民共和国境 内从事快递业务经营、使用快递服 务以及对快递市场实施监督管理， 适用本办法。第三条经营快递业务的企业 应当遵守法律法规和公序良俗，依 法节约资源、保护生态环境，为用 户提供迅速、准确、安全、方便的 快递服务。第四条两个以上经营快递业 务的企业使用统一的商标、字号、 快递运单及其配套的信息系统的， 应当签订书面协议，明确

10、各自的权 利义务，遵守共同的服务约定，在 服务质量、安全保障、业务流程、 生态环保、从业人员权益保障等方 面实行统一管理。商标、字号、快递运单及其配套的 信息系统的归属企业，简称为总部 快递企业。笫五条用户使用快递服务应 当遵守法律、行政法规以及国务院 和国务院有关部门关于禁止寄递或 者限制寄递物品的规定，真实、准 确地向经营快递业务的企业提供使 用快递服务所必需的信息。Article5Theusersthatuseexpressdeliveryservicesshallcomplywithlaws,administrativeregulations,andprovisionsoftheSta

11、teCouncilandtherelevantdepartmentsoftheStateCouncilonitemsprohibitedorrestrictedfromdelivery,andprovidetheenterprisesprovidingexpressdeliveryserviceswiththeinformationnecessaryfortheuseofexpressdeliveryservicesinatruthfulandaccuratemanner.Article6ThepostaladministrativedepartmentoftheStateCouncilsha

12、llberesponsibleforthesupervisionandadministrationofthenationalexpressdeliverymarket.Thepostaladministrativedepartmentofaprovince,autonomousregion,ormunicipalitydirectlyundertheCentralGovernmentshallberesponsibleforthesupervisionandadministrationoftheexpressdeliverymarketwithinitsadministrativeregion

13、.ThepostaladministrativedepartmentbelowtheprovinciallevelformedinaccordancewiththeprovisionsoftheStateCouncilshallberesponsibleforthesupervisionandadministrationoftheexpressdeliverymarketwithinitsjurisdiction.ThepostaladministrativedepartmentoftheStateCouncil,thepostaladministrativedepartmentsofprov

14、inces,autonomousregions,andmunicipalitiesdirectlyundertheCentralGovernment5andpostaladministrativedepartmentsbelowtheprovinciallevelarecollectivelyreferredtoaspostaladministrativedepartmentsn.Article7Thepostaladministrativedepartmentshallconductthesupervisionandadministrationoftheexpressdeliverymark

15、etinanopenandimpartialmanner,encouragefaircompetition,supporthigh-qualitydevelopment,andstrengthenintegratedonlineandofflinesupervisionandadministration.Article8Expressdeliveryindustryorganizationsformedinaccordancewiththelawshallsafeguardthelawfulrightsandinterestsofenterprisesprovidingexpressdeliv

16、eryservices,expressdeliveryterminaloutlets,andexpressdeliverypractitioners,developexpressdeliveryindustrynormsandconventionsinaccordancewiththeprovisionsofapplicablelaws,regulations,andtheirbylaws,strengthenindustryself-regulation,andadvocatelawful,honest,safe,andgreenoperationsofenterprises.Article9Enterprisesprovidingexpressdeliveryservicesshalladheretogreenandlow-carbondevelopment
