5、023)ChapterIGeneralProvisionsArticle1Forthepurposesofregulatingtheadministrationofregistrationofmarketparticipants,protectingthelawfulrightsandinterestsofmarketparticipants,creatingofalawbased,internationalandconvenientbusinessenvironment,fairlyopeningaunifiedandhigh-efficientmarketenvironment,thisR

6、egulationisdevelopedunderthebasicprinciplesprescribedinthelawsandadministrativeregulationsofthestateandinlightoftheactualcircumstancesoftheHainanFreeTradePort(uHNFTP).Article2TheregistrationofmarketparticipantsandrelevantmanagementandserviceactivitiesinHNFTPshallbegovernedbythisRegulation.Theconfirm

7、ationsystemforregistrationofmarketparticipantsshallbeimplementedinHNFTP.Theregistryshall,inaccordancewiththelegalauthorityandprocedures,confirmandpublicizethesubjectqualificationsandregistrationitemsofmarketparticipants.海南自由贸易港市场主体登记 管理条例（2023年11月24日海南省第 七届人民代表大会常务委员会 第七次会议通过）第一章总则第一条为了规范市场主 体登记管理活动

8、，维护市场主 体合法权益，营造法治化、国 际化、便利化的营商环境和公 平开放统一高效的市场环境， 根据有关法律、行政法规的基 本原则，结合海南自由贸易港 实际，制定本条例。第二条 本条例适用于海 南自由贸易港内的市场主体登 记以及相关的管理、服务活 动。海南自由贸易港实行市场主体 登记确认制。登记机关依据法 定的权限和程序，对市场主体 的主体资格和登记事项予以确 认并公示。第三条本条例所称市场 主体，是指以营利为目的从事 经营活动的自然人、法人及非 法人组织，包括公司、非公司Article3ForthepurposesofthisRegulation,umarketparticipantsre

9、ferstonaturalpersons,legalpersonsandunincorporatedorganizationscarryingoutbusinessactivitiesforprofit,includingcompanies,unincorporatedenterpriselegalpersonsandtheirbranches;soleproprietorshipenterprises,partnershipenterprisesandtheirbranches;farmersspecializedcooperatives(associations)andtheirbranc

10、hes;individualindustrialandcommercialhouseholds;branchesofforeigncompanies;andothermarketparticipantsasprescribedbylawsandadministrativeregulations.Article4Astheregistriesofmarketparticipants,themarketregulatorydepartmentsoftheprovincialpeoplesgovernmentsshallberesponsiblefortheregistrationofmarketp

11、articipantsinHNFTPandrelevantsupervision,managementandservicework.Themarketregulatorydepartmentsofthepeople,sgovernmentsofcities,counties,andautonomouscountiesshallberesponsibleforthesupervision,administrationandserviceworkrelatedtotheregistrationofmarketparticipantswithintheirrespectivejurisdiction

12、s.Article5HNFTPshallimplementtheindependentdeclarationandregistrationsystemformarketparticipants,andimplementelectronicregistrationthroughouttheprocess.Anapplicantshallberesponsiblefortheauthenticity,legalityandvalidityoftheself-declaredinformationandmaterialssubmitted.企业法人及其分支机构；个人 独资企业、合伙企业及其分支 机构

13、；农民专业合作社（联合 社）及其分支机构；个体工商 户；外国公司分支机构；法 律、行政法规规定的其他市场 主体。第四条省人民政府市场 监督管理部门是市场主体的登 记机关，负责海南自由贸易港 内的市场主体登记以及相关的 监督管理和服务工作。市、县、自治县人民政府市场 监督管理部门负责本辖区内市 场主体登记相关的监督管理和 服务工作。第五条海南自由贸易港 实行市场主体自主申报登记制 度，施行全程电子化登记。申 请人应当对自主申报信息和提 交材料的真实性、合法性和有 效性负责。申请人通过登记机关的电子化 登记平台，在网上向登记机关 申请市场主体设立、变更、注 销等相关事项，登记机关在网 上受理、审查

14、、确认、发照和 存档。Throughtheelectronicregistrationplatformofaregistry,anapplicantshallapplytotheregistryonlinefortheformation,alteration,cancellationandotherrelatedmattersofmarketparticipants,andtheregistryshallaccept,examine,confirm,issuelicensesandfilethemonline.Themarketregulatorydepartmentsofthepeoples

15、governmentsatorabovethecountylevelshallprovideservicessuchasregistrationconsultation,guidanceandhandlingassistanceformarketparticipants.Article6HNFTPshallimplementtheregistrationcommissionersysteminthewholeisland.Registrationcommissionersshallindependentlyexercisethedutiesofacceptance,examinationand

16、confirmationintheregistrationofmarketparticipantsinaccordancewiththelaw,andassumecorrespondinglegalliability.Forthepurposesoftheprecedingparagraph,registrationCommissionernmeansstaffmembersofthemarketregulatorydepartmentsspecificallyinchargeoftheregistrationofmarketparticipants.Article7Theprovincialpeople,sgovernmentshallestablishandimprovethemarketparticipantregistrationplatform,a
