5、监督检查办法ChapterIGeneralProvisions第一章总则Article1Forthepurposesofstrengtheningandregulatingthesupervisionandinspectionofradiotransmittingequipment,preventingandreducingharmfulinterferencefromthesource,maintainingtheorderofradiowavesintheair,andensuringthenormaloperationofvariousradioservices,theseMeasure

6、saredevelopedinaccordancewiththeAdministrative1.icensing1.awofthePeoplesRepublicofChina,theE-Commerce1.awofthePeoplesRepublicofChina,theRadioRegulationofthePeoplesRepublicofChina,theRegulationontheManagementofRadioTransmittingEquipment,andotherapplicablelaws,regulations,andrules.Article2TheseMeasure

7、sshallapplytothesupervisionandinspectionoftheresearch,development,production,import,sales,andmaintenanceofradiotransmittingequipmentbytheradioregulatoryauthorityofthestateandradioregulatoryauthoritiesofprovinces,autonomousregions,andmunicipalitiesdirectlyundertheCentralGovernment(hereinaftercollecti

8、velyreferredtoasradioregulatoryauthorities).第一条为了加强和规范对无线电发射设备的监督检查，从源头上防止和臧少有害干扰，维护空中电波秩序，保证各项无线电业务的正常进行，根据中华人民共和国行政许可法中华人民共和国电子商务法中华人民共和国无线电管理条例无线电发射设备管理规定等法律、法规和规章，制定本办法。第二条国家无线电管理机构和省、自治区、直辖市无线电管理机构（以下统称无线电管理机构）对无线电发射设备研制、生产、进口、销售和维修环节实施监督检查，适用本办法。第三条国家无线电管理机构负责指导省、自治区、直辖市无线电管理机构开展无线电发射设备监督检查工作，

9、并对各地开展的监督检查工作进行督查和考核评价。Article3Theradioregulatoryauthorityofthestateshallberesponsiblefordirectingradioregulatoryauthoritiesofprovinces,autonomousregions,andmunicipalitiesdirectlyundertheCentralGovernmenttoconductthesupervisionandinspectionofradiotransmittingequipment,andsupervise,assess,andevaluate

10、thesupervisionandinspectionworkconductedinalllocalities.省、自治区、直辖市无线电管理机构依据职责或根据国家无线电管理机构要求，组织开展本行政区域内的无线电发射设备监督检查工作。Theradioregulatoryauthorityofaprovince,autonomousregion,ormunicipalitydirectlyundertheCentralGovernmentshall,accordingtoitsdutiesorasrequiredbytheradioregulatoryauthorityofthestate,org

11、anizethesupervisionandinspectionofradiotransmittingequipmentwithinitsadministrativeregion.国家无线电监测中心和省、自治区、直辖市无线电监测站作为无线电管理技术机构，依据职责承担无线电发射设备监督检查的技术支撑工作。TheStateRadioMonitoringCenterandradiomonitoringstationsofprovinces,autonomousregions,andmunicipalitiesdirectlyundertheCentralGovernmentshall,asradio

12、regulationtechnicalinstitutions,providetechnicalsupportforthesupervisionandinspectionofradiotransmittingequipmentaccordingtotheirduties.第四条无线电管理机构开展无线电发射设备监督检查，可以依据职责和工作需要，联合相关部门共同开展OArticle4Radioregulatoryauthoritiesmay,accordingtotheirdutiesandworkneeds,conductthesupervisionandinspectionofradiotra

13、nsmittingequipmentjointlywithrelevantdepartments.第五条无线电发射设备监督检查工作应当遵循依法依规、权责清晰、分类实施、公平公正的原则。Article5Thesupervisionandinspectionofradiotransmittingequipmentshalladheretotheprinciplesofcompliancewithlawsandregulations,clearrightsandresponsibilities,classifiedimplementation,andfairnessandimpartiality.A

14、rticle6Thesupervisionandinspectionofradiotransmittingequipmentaredividedintoroutineinspectionsandspecialinspections,androutineinspectionsshalltaketherandomselectionofbothinspectorsandinspectiontargetsandthepromptreleaseofresultsasthebasicmethodofroutineinspections.Theinspectionsoftheresearch,develop

15、ment,production,import,sale,andmaintenanceofradiotransmittingequipmentincludedintheannualinspectionplanareroutineinspections.Accordingtotherelevantworktaskarrangementsandrequirements,theinspectionsofspecificobjects,matters,orfieldsarespecialinspections.ChapterIlInspectionContentandRequirementsArticle7Radioregulatoryauthoritiesinspectionsoftheresearchanddevelopment,production,andmaintenanceofradiotransmittingequipmentinclude:(1) whetherradiofrequenciesusedintheresearchanddevelopmentofradiotransmittingequipmentforsaleandusewithinChinacomplywiththeprovisionsofthestateonthealloca
