3、的调整AdjustmentCausedbyMarketPriceFluctuation除专用合同条款另有约定外，市场价格波动超过合同当事人约定的范围，合同价格应当调整。合同当事人可以在专用合同条款中约定选择以下一种方式对合同价格进行调整：Unlessotherwisespecifiedintheparticularconditions,thecontractpriceshallbeadjustedincasemarketpricefluctuationexceedthescopewhichhavebeenagreedbypartiesheretowhichmayselectoneoffollo

4、wingwaysinparticularconditionstoeffecttheadjustmentofprice.第1种方式：采用价格指数进行价格调整。Thefirstway:priceadjustmenteffectedbypriceindex.(1)价格调整公式FormulaofPriceAdjustment因人工、材料和设备等价格波动影响合同价格时，根据专用合同条款中约定的数据，按以下公式计算差额并调整合同价格：Providedthatthepricehavebeenaffectedbythepricefluctuationoflabour,materialzequipmentand

5、other,thedifferenceshallbecalculatedandpricebeadjustedaccordingtothedatastipulatedintheparticularconditions;公式中：AP-需调整的价格差额；Intheformula:PThepricedifferencewhichisnecessarytoeffectadjustment;-约定的付款证书中承包人应得到的已完成工程量的金额。此项金额应不包括价格调整、不计质量保证金的扣留和支付、预付款的支付和扣回。约定的变更及其他金额已按现行价格计价的,也不计在内；Theamountofthecomple

8、stablefactorreferstothepriceindexofeachadjustablefactorforthe42daysofthelastdayoftherelevantperiodintheagreedpaymentcertificate;-各可调因子的基本价格指数，指基准日期的各可调因子的价格指数。Thebasicpriceindexofeachfactorreferstothepriceindexofeachvariablefactoronthebasedate.以上价格调整公式中的各可调因子、定值和变值权重，以及基本价格指数及其来源在投标函附录价格指数和权重表中约定，非招

9、标订立的合同，由合同当事人在专用合同条款中约定。价格指数应首先采用工程造价管理机构发布的价格指数，无前述价格指数时，可采用工程造价管理机构发布的价格代替。Eachadjustablefactor,fixedvalueandvariableweightintheaboveadjustmentformulaandbasicpriceindexanditssourceswillbestipulatedintheappendixofpriceindextothebidletter,withrespecttothenon-bidingcontract,willbestipulatedbypartiesheretoinparticularconditions.Thepriceindexshouldfirstadoptthesamepublishedbytheprojectcostadministrator,wherewithoutaforesaidpriceindex,thepricepublishedbytheprojectcostadministratormaybeappliedinlieuoftheaforesaidpriceindex.
